Definition of Wrongful Death

Wrongful death occurs when an individual is killed from the negligence or wrongful actions of another person. Wrongful deaths commonly occur from defective drugs, car accidents, defective products and medical malpractice.

Wrongful death actions may be brought by the surviving family member of the deceased and are generally handled by personal injury lawyers. Laws may determine who is able to file the wrongful death claim, but the survival action is generally filed by the executor of the deceased's estate. Damages for wrongful death may be determined by state law and may vary, but generally include compensation for comfort, guidance, assistance, protection, and income.
