Definition of Personal Injury Lawyer

The personal injury lawyer may either work for the prosecution or the defense. Prosecuting attorneys will attempt to provide enough evidence to the court to convince the jury that the defendant is guilty through a "preponderance of evidence" (for a civil case). Personal injury lawyers can help the claimant win compensation for their loss by proving the defendant had a duty of care toward the plaintiff, the duty was breached, this breach of duty caused the plaintiff's injuries and the plaintiff suffered loss. Personal injury lawyers generally work on a contingency fee basis and are not paid unless the plaintiff is awarded damages.
