Definition of Per se Law

It is illegal to operate a motorized vehicle with a blood alcohol concentration level (BAC) of more than 0.08%. This is considered per se intoxication and drivers can be arrested for DUI or driving under the influence regardless of whether or not the driver is mentally or physically impaired and unable to safely operate their motorized vehicle.
