Definition of Pedestrian Accidents

The National Highway Traffic Safety Association estimates close to 80.000 pedestrians are injured in a car or truck accident each year. Injured pedestrians may have the legal option to recover damages for their losses if they can prove all of the necessary elements of their personal injury claim. The pedestrian must prove the driver owed them a duty of care, the driver breached their duty, the breach of duty caused their injury and they suffered injury or loss. Liability for an accident may not be limited to the driver. Depending on the circumstances of the case the pedestrian may also be partially to blame. State laws differ on the methods used to compensate the victims in personal injury claims if more than one party is responsible.
