Definition of Damages

Damages are usually paid in a personal injury claim if an individual suffers personal injury or harm and can prove the defendant owed them a duty of care and their negligence caused their loss. Damages can be paid for non-monetary loss and can include: pain and suffering, loss of consortium, loss of mental or physical capacity and loss of reputation.
