Definition of Complaint

A complaint in a civil action is the first action by the plaintiff to explain the facts in which the claim is based. A complaint in a criminal action is the charge of accusation made by the plaintiff against the defendant. A complaint does not initiate a trial in a criminal crime but depends on an indictment from the state against the defendant.
