Definition of Burden of Proof

Burden of proof is the duty placed on the prosecution in a criminal case to prove that the defendant is guilty of a crime. A plaintiff in a car accident claim will have the burden of proof to prove any disputed facts of the crime. The burden of proof in a criminal case is "beyond a reasonable doubt". If the legal case is a civil claim the burden of proof is established through a "preponderance of the evidence" or proof by "clear and convincing evidence".
